FOR WHAT PURPOSES DO WE PROCESS YOUR PERSONAL DATA?

In accordance with the provisions of EU Regulation 679/2016 and Organic Law 3/2018 of December 5 on the protection of personal data and guarantee of digital rights, we inform you that the personal data you provide us and those that are generated during the development of relationship with you, are processed for the following purposes:

  • To attend to the requests that you make to us.
  • To provide you with information about APRIA SYSTEMS SL products, consenting to the sending of commercial communications by e-mail or by any other equivalent means of electronic communication (such as SMS) that you have provided us with.
  • If you send us a resume, your application will be evaluated in the recruitment process.
  • The sending of communications by any means that you have provided us, related to the activities developed by the entity and that could be of interest to you.
  • The response to queries, complaints and suggestions, and the realization of all kinds of communication actions.
  • The accounting, fiscal and administrative management of the entity.

How long will we keep your data?

The personal data provided will be kept as long as their deletion is not requested by the person concerned, or whoever legally acts as his legal representative and this is appropriate, and as long as they are necessary - including the need to keep them during the applicable statute of limitations - or relevant for the purpose for which they were collected or recorded.

The data conservation will be conditioned to the legal obligation that APRIA SYSTEMS SL has to conserve them. Once these terms are exceeded, the data will be destroyed or erased, the suppression, elimination or destruction being carried out in such a way that the information contained in the supports is not recoverable.

Legitimacy

The legal basis for the processing of your data is the consent given by the person concerned. This is obtained expressly and unequivocally by completing and, where appropriate, sending the documents and paper or electronic forms in which your data is collected. In all documents of the entity, which are used to collect data for different uses, there are informative clauses in accordance with the provisions of the data protection regulations and consent is expressly expressed by the signature of the person concerned, or by sending the existing forms on the website.

It is also a cause of legitimacy when this treatment is necessary for the execution of a contract, or the provision of a service provided to the persons concerned, in which they are party, or for the application at their request of pre-contractual measures (art. 6.1.a and b RGPD).

APRIA Systems S.L. is also legitimized to process your data to comply with the legal obligations to which it is subject and for the satisfaction of legitimate interests, provided that these do not override the interests or fundamental rights of the persons concerned.

Whatever the cause of legitimacy, consent may be revoked at any time.

To which recipients will your data be communicated?

Your data will not be transferred to any entity without your consent except for the legally foreseen transfers, in this sense your express consent will be requested for the transfer of your data to any other entity.

As a consequence of the management of the authorized purposes, your data could be communicated to entities or persons directly related to APRIA SYSTEMS SL and with the services provided by the same. Likewise, your personal information will be at the disposal of the Public Administrations, Judges and Courts, for the attention of the possible responsibilities born from the treatment and whenever these cessions are protected in the law.

Your data may also be transferred to companies that provide us with some kind of consulting services, computer maintenance, marketing, training or auditing. These entities only have access to the personal information that is necessary to carry out these services, requiring through a contract of "data processing assignment" that they maintain confidentiality, that they cannot use the information for other purposes and that they adopt the measures that guarantee the integrity and availability of the information.

International data transfers outside the European Union area or to entities that do not comply with the data protection standards established by EU Regulation 679/2016 are not foreseen.

The personal data processed by APRIA SYSTEMS SL are provided by the person concerned, or obtained from sources accessible to the public.

What are your rights?

Any person has the right to obtain confirmation as to whether APRIA SYSTEMS SL treats personal data concerning him/her, or not.

Interested parties have the right to access their personal data and to obtain a copy of the personal data being processed, to update it, as well as to request the rectification of inaccurate data or, where appropriate, to request its deletion when, among other reasons, the data is no longer necessary for the purposes for which it was collected.

In certain circumstances and for reasons related to their particular situation, data subjects may object to the processing of their data. APRIA Systems S.L. will stop processing the data, except for compelling legitimate reasons, or the exercise or defense of possible claims.

In certain circumstances, as provided for in Article 18 of the GDPR, data subjects may also request the restriction of the processing of their data, in which case APRIA Systems S.L. will process them, except their storage, with the consent of the data subject or for the formulation, exercise or defence of claims, or the protection of the rights of another natural or legal person or reasons of important public interest of the Union or a specific Member State.

If applicable, as a consequence of the application of the right to erasure or opposition to the processing of personal data in the on-line environment, data subjects have the right to be forgotten according to the jurisprudence of the Court of Justice of the EU.

Under the right to portability, data subjects have the right to obtain the personal data concerning them in a structured, commonly used, machine-readable format and to transmit it to another data controller.

Any data subject has the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects on him or her or similarly significantly affects him or her, subject to the exceptions provided for in Art.22.1 RGPD.

The person concerned has the right to the deletion of his/her data, due to the disappearance of the purpose for which the data was processed or collected, due to revocation of consent when this is the one that legitimizes the processing, or for the other reasons contained in Article 17 RGPD. Deletion will be carried out by high-level erasure of data contained in automated media and physical destruction of non-automated media.

How can rights be exercised?

By means of a letter, always accompanied by a copy of the ID card or other document that proves the identity of the interested party, addressed to the addresses indicated in the heading.

What complaint procedures are available?
